It is time for all progressives to stand up and ask for Keith's resignation at NBC's website. Afterall, some progressives got angry just because ABC moderators asked some tough and (maybe) unfair questions, but really assassination belongs to dictatorships! If so-called liberal bloggers (Kos, ObamaPost,  Marshall) have any love for democracy then they are also welcome to join us in this protest.

I also have a question for the lawyers out there- I am not a lawyer, but isn't suggesting assassination of a presidential nominee  a felony.

PS: For all those who are defending Keith, please explain ``a superdelegate goes into a room with Clinton and only the superdelegate comes out'' does not mean he is calling for murder. Let us put this hypothetical question to you. Say OReilly suggests this solution for bringing the Dem Nomination to close- ``A white guy goes into the room with Sen. Obama and only the white guy comes out.'' What would your reaction be? You will be defending or attacking O'Reilly. If attacking, then you must apply the same standards to Keith.

Nowhere did he call for assassination. The context was clearly about a super-superdelegate -- a party 'elder' being strong enough to convince Clinton to back down. That's the context. I wish the clip was longer to provide the necessary context.

A crime requires actus reus.  Put it another way, a Criminal ACT requires just that, an "act."

It's a fine line.  

The voluntary act requirement keeps us from crossing the line into punishing "thoughts" because that would give the state too much power to arbitrarily prosecute.

A threat can be considered an "Act" if there is actually some likelihood of pulling it off.  For example, I could threaten to cut you and it would just be a threat.  But, if I had a knife in hand, the threat would cross into the "Act" realm and we could stop me from the potential crime.

The line is closely adhered to.  For example, there was a case where an HIV+ inmate told the guard that he was going to kill him by infecting him with HIV (which is INTENT) and then spit on him (the ACT).  Court acquitted him of murder because spitting on someone is an almost certain to be harmless from a disease standpoint, so there was really no criminal Act, even though there was a criminal state of mind.

Also, with certain things where we expect a greater level of security  or emphasis on security, the balance tips against the person threatening - so you can't say you hid a bomb at the airport (though you wouldn't be guilty of terrorism, but of something else related to your hoax)

With Keith's comments, assuming the ridiculous Diarist's reading, he clearly posed no credible threat from his MSNBC studio at Rockefeller Center.
